In Greene County district court John Edward Abernathy, 48, of Scranton was sentenced Aug. 21 after changing his plea to guilty in April to a charge of arson-second degree. He was granted a deferred judgment and placed on probation for three years. The minimum fine was suspended, but he must pay $141,902.99 restitution to State Farm Insurance and $241.50 court costs. Richard Charles Hiram Lampe III, 42, of Jefferson was sentenced Aug. 22 to two years in prison after he changed his plea to guilty to a charge of theft of services-third degree. The prison time was suspended and he was placed on informal probation for two years. He was fined $625 with a $218.75 surcharge and a $125 law enforcement initiative (LEI) surcharge. He must also pay $963.79 restitution to the city of Jefferson for unmetered water usage, $90 restitution for his court appointed attorney’s fees and $120 court costs. (Sentencing: Honorable Adria A. Anthony Charles Kennedy, 32, of Jefferson was sentenced Aug. 22 after he changes his plea to guilty to a charge of assault on a peace officer. He was sentenced to two years in prison. The prison term was suspended and he was placed on probation for two years. He must reside at a residential correctional facility until maximum benefits are attained. He was fined $625 with a $218l75 surcharge. He must also pay $90 restitution for his court appointed attorney’s fees and $140 court costs. A charge of interference with official acts was dismissed. Michelle Denise Rader Smith, 43, of Jefferson pleaded not guilty Aug. 22 to a charge of operating while intoxicated (OWI)-first offense. A trial date was set for Sept. 30.
Cases were initiated in district court during the week ending Aug. 22 as follows: Danny Lee Cannon, 57, of Perry, OWI-first offense; Richard Charles Burkhardt, 45, of Jefferson, public intoxication-third or subsequent offense; Shawn Patrick Maloney, 44, of Scranton, sex abuse-second degree (two counts) and lascivious acts with a child (two counts); Jamy Steven Zinke, 37, of Nora Springs, operating a commercial vehicle while disqualified; and Jameson Todd Ross, 22, of Runnells, assault while displaying a dangerous weapon and carrying a weapon while intoxicated.
